Ask Patents is a question and answer site for people interested in improving and participating in the patent system. It's 100% free, no registration required.

Let us say I work for company X and have an idea that I want to patent outside the scope of work of that company. Is it mandatory that I get a waiver of interest from X BEFORE I file a provisional patent application, or is it sufficient to get one before the full patent application?

What happens when there are more than one authors from different companies, and only one of them manages to get a waiver of interest?

I'd get advice from an attorney who knows the ip related employement laws of your state and who has your employee agreement in front of them. –  George White May 21 '13 at 3:54
