Ask Patents is a question and answer site for people interested in improving and participating in the patent system. It's 100% free, no registration required.

I just want to make sure that I am reading the answers to similar questions correctly. Here is my question: Suppose I have a provisional app that has apparatus A and B. A non-provisonal is filed off of the provisional describing only A. The non-provisional has not issued yet. Can I file a continuation for apparatus B that claims the benefit of the provisional application even though apparatus B was not described in the non-provisional?

I think the answer is yes, but just want to make sure (or maybe I have to file a CIP?).

Thanks!!
