@Kalpesh - If this is a final abandonment it means that the USPTO wanted an answer to a query and the applicant did not reply. If you go into Public Pair (link in reply) and search the publication number 20120228338 you will be able to choose "Image File Wrapper" and download the whole correspondence. To be sure that this is final consult a patent attorney, because there may still be a slim chance that they could revive the application, but it looks to me as though the application has been abandoned.

You should consult a patent attorney or a lawyer specializing in Intellectual Property law for that sort of advice. It depends on a lot of things, including where and how you might market the product. This could be a problem in Indian law and/or US law or international law according to the various agreements that there may be. The threat may be a bluff, but may not be. A large company may threaten a small one knowing that the costs of defending will be large. This is not a forum to give specific advice for legal isues.

Not quite. The WO is only an application. The record for the DK shows as legal status 2008/01/21 APPLICATION SHELVED FOR OTHER REASONS THAN NON-PAYMENT and so has no validity. However, the header mentions an EP. These are also to Vikan and the inventor is Anders Florvik. The family consists of DK176309, EP1849393 and NO20072182. The DK and NO statuses are not available on Espacenet but the EP appears to have been maintained (fees paid) in DE, GB, SE and FR at least. You are right, of course, that there is no US validity.

They are certainly different chemical compostions. Presumably USPTO decided that the '044 composition was not obvious to "one skilled in the art" on the basis of '255 (and other prior art)

Agreed with user96. However, one of the problems of process patents is that if the alleged infringer may have found a way to take advantage the spirit of the invention while not following the exact terms of the claims, then he is probably in the clear. That is one reason why professional help should be used in formulating the claims.
