Are the following patents European only? EP 1849393 B1 and WO2005108015 (A1) Not quite. The WO is only an application. The record for the DK shows as legal status 2008/01/21 APPLICATION SHELVED FOR OTHER REASONS THAN NON-PAYMENT and so has no validity. However, the header mentions an EP. These are also to Vikan and the inventor is Anders Florvik. The family consists of DK176309, EP1849393 and NO20072182. The DK and NO statuses are not available on Espacenet but the EP appears to have been maintained (fees paid) in DE, GB, SE and FR at least. You are right, of course, that there is no US validity. |

Can I get a website recommendation which helps in making a patent process? Please note that the possible dupe listed relates to US only. Perhaps the user wants to start in another authority? Most of them have a guide on their website and as a general answer the user should be pointed to them. |

What is the USPTO attitude toward mouth rinse patents, particularly given many seem to overlap? They are certainly different chemical compostions. Presumably USPTO decided that the '044 composition was not obvious to "one skilled in the art" on the basis of '255 (and other prior art) |

Do patents offer protection from private use? Agreed with user96. However, one of the problems of process patents is that if the alleged infringer may have found a way to take advantage the spirit of the invention while not following the exact terms of the claims, then he is probably in the clear. That is one reason why professional help should be used in formulating the claims. |
