This question has been asked before and already has an answer. If those answers do not fully address your question, please ask a new question.

  • Asking if a particular patent is a design or utility patent is a duplicate. If the question were limited to the second question about the sunglass lens, I would be in favor of leaving it open. – Eric Shain Aug 4 '17 at 22:07

US20170153408 is an utility patent application. Utility patents describe a process/method of production of an article/device. Design patents protect the visual/aesthetic appearance of an article. If you're planning on patenting a novel way of making the sunglasses lens you'd need to file an utility patent. In your case I feel you just need to protect the design of your lens hence a Design Patent should suffice.

Hope this helped!

  • You might want to clarify that the linked document is a application and not yet a granted patent. – Eric Shain Aug 2 '17 at 14:40
  • how do you know if this patent is design or utility, as no marking is mentioned on the patent? – Firas Abbasi Mar 30 '18 at 7:47
