The rejected tag is used on patent applications and patents which have been successfully narrowed or rejected by the USPTO after having been the subject of a prior-art-request on Ask Patents.

The tag is used to tag which have been successfully narrowed or rejected by the USPTO after having been posted on Ask Patents. If the USPTO rejection cites prior art which was discovered at Ask Patents this can be indicated in the appropriate answer with a special graphic.

Questions on which to use the tag:

  • US Patent Applications which were the subject of a on Ask Patents and which have subsequently been given a non-final or a final rejection by the USPTO.

  • Issued US Patents which were the subject of a and which have been subsequently rejected or narrowed by the USPTO in a post-grant review or inter-partes review.

The purpose of the tag is to focus community effort on finding prior art for which have not yet been rejected by the USPTO. Plus it's nice to celebrate success. The tag may be used if the application / patent was narrowed / rejected after a prior art request but without measurable contribution of this community to indicate that a prior-art-rquest question is no longer relevant / needs no more answers.
